These Terms of Service ("Terms") govern your use of Creative Engine's platform, services, and applications (collectively, the "Service"). By using our Service, you agree to these Terms.

1. Account Registration

To use most features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Be responsible for all activity under your account

2. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code or content that infringes intellectual property rights
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service's operation
  • Use the Service to send spam or unsolicited communications
  • Scrape or collect data from the Service without permission

3. Your Content

You retain ownership of all content you create using the Service. By using our Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

You are responsible for ensuring your content does not violate any laws or third-party rights.

4. Subscription and Billing

  • Free Plan: Available with limited features at no cost.
  • Paid Plans: Billed monthly or annually. Prices are subject to change with 30 days' notice.
  • Cancellation: You may cancel at any time. Access continues until the end of the current billing period.
  • Refunds: Annual subscriptions are eligible for a pro-rated refund within the first 30 days.

5. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Creative Engine and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

6. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect and use your data.

7. Service Availability

We strive for 99.95% uptime but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. Enterprise customers receive SLA guarantees as specified in their agreement.

8. Limitation of Liability

To the maximum extent permitted by law, Creative Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold Creative Engine harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your content will be deleted within 30 days.

11. Changes to Terms

We may modify these Terms with 30 days' notice. Continued use of the Service constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
